What is a real
estate settlement?
A real estate
settlement is the process whereby the buyer of real estate
property becomes the legal owner. During this process, the
buyer provides funds to the seller in exchange for the deed to
the property.
What does a
settlement company do?
A
settlement company will make sure that a good, marketable and
insurable title transfers between seller to buyer; all of the
settlement documents will explained, properly signed, and
recorded; the sellers mortgage loan(s) will be paid off and
those obligations released. The attorney will
conduct the settlement according to the terms and conditions of
the contract of sale and instructions from the lender.
What is title
insurance and why is it necessary?
There is always the
possibility of title discrepancies or irregularities. Your
title could be improperly recorded or abstracted. There
could be hidden title defects (e.g. fraud, forgery, missing
heirs, impersonation, or the rights of divorced persons, etc.)
that even the most thorough search would not uncover.
Title insurance will protect and defend (at no cost to you) your
ownership interest in real property from any such defects in the
title.
